Indian Architects Act 1972

 Clause 14:
1.        The qualifications included in the schedule or notified under section 15 shall be recognised qualifications for the purposes of this Act.
2.      Any authority in India which grants an architectural qualification not included in the schedule may apply to the Central Government to have such qualification recognised, and the Central Government, after consultation with the Council, may, by notification in the Official Gazette, amend the schedule so as to include such qualification therein, and any such notification may also direct that an entry shall be made in the schedule against such architectural qualification declaring that it shall be a recognised qualification only when granted after a specified date.
3.      Provided that until the first Council is constituted, the Central Government shall, before, issuing any notification as aforesaid, consult an expert committee consisting of three members to be appointed by the Central Government by notification in the official Gazette.

Interpretation:  This clause deals with recognition of qualifications granted by authorities in India. The council had made a schedule of qualifications which are recognised qualifications for being a registered Architect. There are different types of architectural courses in India like Degree courses and Diploma courses. If any authority which is providing these courses and which is not included in the schedule, can apply to central government to recognise these courses and to add these in architectural qualification schedule made by council. Then to make amendment in the schedule, the central government will consult with council and if council finds the course appropriate for architectural qualification, only then central government will amend the schedule by giving notification in the official gazette and after that these architectural qualification will be recognised qualification with a specified date.  This clause leaves a question that what will happen to people who have taken their qualification before the specified date? Or there any chances to get recognition individually??

Clause 15:
  1. He Central Government may, after consultation with the Council, direct, by notification in the Official Gazette, that an architectural qualification granted by any university or other institution in any country outside India in respect of which a scheme of reciprocity for the recognition of architectural qualification is not in force, shall be a recognised qualification for the purposes of this Act or, shall be so only when granted after a specified date or before a specified date :
    Provided that until the first Council is constituted the Central Government shall, before issuing any notification as aforesaid, consult the expert committee set up under the proviso to sub-section (2) of section 14.

  2. The Council may enter into negotiations with the authority in any State or country outside India, which by the law of such State or country is entrusted with the maintenance of a register of architects, for settling of a scheme of reciprocity for the recognition of architectural qualifications and in pursuance of any such scheme, the Central Government may, by notification in the Official Gazette, direct that such architectural qualification as the Council has decided should be recognised, shall be deemed to be a recognised qualification for the purposes of this Act, and any such notification may also direct that such architectural qualification, shall be so recognised only when granted after a specified date or before a specified date.
Interpretation:  This clause deals with recognition of qualifications granted by foreign authorities. If some authority outside of India, providing architectural qualification which in not scheduled, can apply to central government for recognition. Then central government may after consulting with council make amendment in the schedule by giving notification in the official gazette and those qualifications will be recognised qualification with a specified date. In this process, council may do some negotiations with that foreign authority for setting of scheme of reciprocity for the recognition of architectural qualifications.
The council has authority to decide whether qualification from any foreign authority should be given recognition or not but it leaves a question that how they assure the quality of education? Are council going to take regular examination of that institution to assure quality as they do in any Indian institution?


Tender selection criteria and Process

Tender document studied for research are-
1.      Expression of interest document for construction of Indian Institute of Information Technology, Kurnool, Andhra Pradesh
2.      Tender document for construction of Forestry Training Institute Building at Hizli, Kharagpur
3.      Tender document for construction of Faculty Housing of Indian Institute of Technology, Indore, M.P.



An EOI or tender of architectural consultancy is to invite Architects/ architectural firms to bid for proposed work. This tender document carries information about scope of work, area of site, approx. cost of project, site condition and time period of completion, role of selected consultancy firm. It covers the minimum qualification and experience and financial capability of the architect/ architectural firm. Tender is divided in two parts like technical bid and financial bid. The technical bid covers the eligibility criteria and general instructions, general terms and conditions, services to be rendered by the architectural firm. Qualifications of the Architect Structural Engineer, Civil engineer, Surveyors, Supervisors, etc. who will be engaged in the project. The work experience and the details of similar projects undertaken may be also be included in the Technical Bid.

The Financial Bid contains the basic fee.
The time of submission of tender is clearly stated and asked to follow strictly. The tender document contains the general instruction of architect/firm which will be followed. The tender clearly states about the time period of planning phase and execution phase. It also mentions the earnest money which will be paid by architect/firm. The tender document gives the profarma of technical and financial bid.  The tender document mentions requirement to submit for tender which are- N.I.T., Bill of quantities, General conditions of contract, Special conditions of contract, Technical Specifications, Makes of Materials and Schematic drawings.
Once the tender are submitted, the tenders are shortlisted on basic criteria of documentation then technical bid is opened to further shortlist tenderers. Tenders are checked at each criteria and if any tender doesn’t fulfil all the criteria, got rejected.  After shortlisting the tenders, financial bid is opened for awarding the tender. The jury award tender to the tenderer who has quoted the least bid.
In this whole process of selection, the main flaw which author has noticed is that sometimes a tenderer who has a better technical bid does not get the tender because someone other tenderer who has quoted least fee with average technical bid has got the tender because final criteria of awarding tender is used to see the least bid of fee quoted. This whole process leaves a question in author’s mind that shouldn’t tender be awarded on giving both technical and financial bid same importance?

Architectural competitions are another best way to get architectural projects for Architects/architectural firms. Competitions helps in both ways. On one hand client gets so many creative ideas and on the other hand competitions give chance to young architects and experienced architects to show their creativity on a same platform. While choosing the appropriate competitions, architects should know their interest and capability. The criteria of selection of competition can be-
§  What is the Size of competition?
§  What is type of competition like UD project, Landscape Design or Building design etc.?
§  When submission is going to happen?
§  What is the eligibility criteria to participate in the competition?
§  How many stages are in the competition?
§  How much time will it take till announcement of result?
§  Is there any entry fee for participating in the competition?
§  What is format of submission of submission?
§  What are the awards?
§  Can competitor reproduce that work for any other competition, if that submission is not a winning for this competition?
Sometimes in competitions, competitor have to submit Cost estimates, specifications with design proposals.

Going through the competitions, a question came in author’s mind are-
§         In most of competition, organiser have the copyright to use the submission without permission of competitor and competitor are not authorised to use/reproduce this submission in any case. Is it fair to giving copyright to organiser for competitors’ designs?





Architecture practice_2040

India is a developing country where Architects have a great importance whose job is more than to design & build only buildings. Architect helps and plays a significant role in improving the well-being of the societies. At present time, we are trying to fulfil the basic requirement of society by providing everyone a shelter. And doing this, architects face a lot of problems like the population of India is so much and there are not sufficient land in cities with respect to population which causes to create high density in cities. And to fulfil our requirement, we are making a lot of new buildings but after 25 years from now there will be a lot of population and very few spaces for new construction will be left. So at that moment, to cater everyone’s basic need and maintaining the standard of lifestyle, new innovative ideas will be required. At that time, we will have situations more complicated than now. At that moment we will have a great history to tell the world and an upcoming future of which requirements we have to take care of. To handle the future’s requirement, we need very innovative and sustainable ideas because the context of buildings keep evolving. In all these works, my contribution as an Architect will be design better spaces for society by using new technologies, innovative sustainable ideas which are applicable everywhere. At that moment, our goal will not be proving basic requirement of society. Our goal will be maintaining a standard lifestyle of society by providing everyone to shelter, basic health and educational facilities and a better transport system.
Till that date, I will be prominent face of architecture whose clients will be both ends. For high end clients, I will do some luxurious projects according to their need on the other hand I will start a NGO to work for them, who are still fighting to get standard life and shelter. I have a dream to see the cities without people sleeping on roadside. I will fight for my dream and make it come true according to my potential.
Till that I will keep myself updated with new technologies without forgetting our moral values. I will prove my worth to  the country.
  Above of all, the main motto of me would be to pass a better and safe society to our upcoming generations.
